1. Acceptance of Terms

By accessing or using the Heaven platform ("Service"), you agree to be bound by these Terms of Use. The Service is provided by Heaven ("Company", "we", "us", or "our"). If you do not agree to these terms, do not use the Service.

2. Description of Service

Heaven is a SaaS platform providing analytics, real-time telemetry monitoring, and automation tooling for the Australian National Electricity Market (NEM). The Service includes grid topology visualization, compliance automation features, and BESS (Battery Energy Storage System) optimization modeling.

3. Market Data & Third-Party Disclaimers

The Service aggregates and displays data sourced from the Australian Energy Market Operator (AEMO) and other third-party providers. While we strive for accuracy, Heaven does not guarantee the timeliness, completeness, or accuracy of any AEMO dispatch data, spot prices, or market notices displayed. All AEMO data is utilized under applicable AEMO licensing terms.

4. No Financial Advice

Heaven is an analytics and execution tool, not a financial advisor.None of the outputs, including optimization recommendations, predictive maintenance alerts, or automated recalibrations, constitute financial, investment, or trading advice. Users are solely responsible for all trading decisions, capital allocations, and bids submitted to the NEM, whether executed manually or via our automated APIs.

5. Limitation of Liability

To the maximum extent permitted by law, Heaven and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data loss, or physical damage to grid assets resulting from the use or inability to use the Service. Our total liability shall not exceed the amount you paid us in the past twelve (12) months.

6. Account & Billing

Users must provide accurate billing information and maintain the security of their API keys and JWT credentials. Subscription fees for Standard, Premium, and Enterprise tiers are billed in advance on a recurring monthly or annual basis. Failure to pay may result in immediate suspension of API access and dashboard capabilities.
